California’s Dog Bite Law: What You Need to Know

California Civil Code Section 3342 makes dog owners strictly liable when their dog bites someone. Strict liability means the owner is responsible regardless of whether the dog had ever bitten anyone before. You don’t have to prove the owner knew the dog was dangerous.

To recover under this statute, you must show the bite occurred while you were in a public place or lawfully on private property. Lawful presence includes being there at the owner’s invitation, express or implied, as well as performing a duty required by law, such as delivering mail.

When the Statute Doesn’t Apply

Section 3342 has limits. Trespassers aren’t covered. Dogs working for law enforcement or the military are exempt from strict liability while performing official duties, though bystanders injured in those situations may still have a path to recovery. People in occupations that carry an inherent risk of dog bites, such as veterinarians, may be barred from strict liability claims, though a negligence claim may still be available to them.

Owners can also raise a provocation defense if the injured person teased, tormented, or otherwise provoked the dog before the bite.

Comparative Negligence & the Filing Deadline

California follows a pure comparative negligence rule. If a court finds you were partially at fault, your compensation is reduced by that percentage rather than eliminated entirely. A 20% fault finding on a $100,000 recovery, for example, reduces the award to $80,000.
