Types of Child Custody in California

California law recognizes two distinct dimensions of custody, and understanding both helps you know what you’re negotiating for.

Legal custody is the right to make decisions about your child’s health, education, and welfare. Physical custody determines where your child lives. Courts can award joint or sole arrangements for each type, and the two don’t always mirror each other. Joint legal custody is common in California and doesn’t automatically mean equal parenting time. A parent may share decision-making authority while the child primarily resides with one parent, with visitation rights granted to the other.

The Best Interests of the Child Standard

Every custody and visitation decision in California is governed by the best interests of the child standard. Modifying or Enforcing an Existing Custody Order
