Who Can File a Wrongful Death Claim in California

California Code of Civil Procedure Section 377.60 defines who has legal standing to bring a wrongful death claim. The right to file belongs first to the decedent’s surviving spouse or registered domestic partner, children, and the children of any deceased children. If none of those primary beneficiaries exist, the right may pass to other heirs under California’s intestate succession laws, including parents or siblings.

Certain financially dependent individuals may also qualify. That includes a putative spouse (someone the court finds believed in good faith that their marriage to the decedent was valid), that person’s children, and stepchildren who were financially dependent on the decedent. In blended families, questions of standing can become complicated quickly. Identifying who has the right to file early in the process helps avoid delays and protects the claim.
