Understanding Civil Litigation: Contract Disputes & Tort Cases

Civil litigation covers a broad spectrum of non-criminal legal disputes between individuals, businesses, or government entities. Our firm primarily focuses on two significant areas:

CONTRACT DISPUTES

A contract is a legally binding agreement outlining parties' terms, conditions, and obligations. When one party fails to uphold their end of this agreement, it leads to a contract dispute or "breach of contract." These disputes are common in various aspects of life and business.

They can include the following:

  • Business agreements. Disputes over partnerships, vendor contracts, service agreements, or supply chain issues.
  • Real estate contracts. Conflicts arising from purchase agreements, leases, or property development deals.
  • Construction contracts. Disagreements between homeowners, contractors, or subcontractors regarding project scope, delays, or quality of work.
  • Employment agreements. Disputes concerning employment contracts, non-compete clauses, or severance agreements.
  • Loan agreements. Issues related to repayment, default, or terms of a loan.

TORT CASES

A tort is a civil wrong that causes harm or loss to another person for which the law provides a remedy. Unlike contract disputes, which stem from an agreement, tort cases arise from a duty of care owed by one party to another that was breached, leading to injury or damage.

Examples of Tort cases can include:

  • Personal injury. Instances where someone is physically injured due to another's negligence (like car accidents, slips and falls, and dog bites).
  • Property damage. Disputes where one party's actions (or inactions) damage another's real or personal property.
  • Business torts. Wrongful acts committed by one business against another, such as interference with contracts or unfair competition.
  • Defamation. Harm to reputation caused by false statements (slander or libel).
  • Intentional torts. Cases involving deliberate actions that cause harm, such as assault, battery, or false imprisonment.

What Remedies May be Available?

The remedies available in civil litigation aim to “make the injured party whole” or enforce contractual obligations. Depending on the specifics of your case, we may pursue:

  • Compensatory damages. Monetary awards designed to compensate you for actual losses incurred. This can include economic (quantifiable losses) and non-economic damages, such as pain and suffering.
  • Specific performance. A court order compelling the breaching party to fulfill the contract's exact terms, rather than paying damages. This is often sought when monetary damages are insufficient.
  • Rescission. Canceling the contract and returning the parties to their positions before the contract was made.
  • Restitution. Recovering money or property that the other party unjustly obtained.
  • Injunctive relief. A court order requiring a party to perform a specific action or, more commonly, to cease a specific action (such as preventing a former employee from violating a non-compete clause).
  • Punitive damages. In cases of egregious or malicious conduct, these are awarded to punish the at-fault party and deter similar behavior in the future. These are typically sought in tort cases.
  • Attorney fees and costs. In certain contract disputes or when allowed by statute, we may seek to recover your legal fees and court costs from the opposing party.
